Identify what is being signed and which law applies. The federal E-SIGN Act addresses the legal effect of electronic records and signatures in covered transactions. Its requirements include record access and retention, and additional steps for specified consumer disclosures.
Review the applicable state electronic transaction statute and the formalities of the specific document. Keep this legal analysis alongside the signing record. The checklist helps organize the evidence; the document type and transaction determine the review.

Preserve agreement, intent and authority.
Retain the parties’ agreement to use the electronic process and evidence that the signature expresses the signer’s intent. Confirm the person’s authority when signing for a company, trust or other party. A name in a signature block and authority to bind the party are separate questions.
For a covered consumer disclosure, review the affirmative consent and access requirements in 15 U.S.C. § 7001(c). Retain the applicable notices, consent and evidence of the process used with the final record.
