Initial Disclosures Deadline: 14 Days After the 26(f) Conference
Make initial disclosures at or within 14 days after the Rule 26(f) conference (Rule 26(a)(1)(C)). Enter the conference date and calculate the due date.
The working answer
A party makes its initial disclosures at or within 14 days after the parties' Rule 26(f) conference, unless a stipulation or court order sets a different time (Fed. R. Civ. P. 26(a)(1)(C)). A party first served or joined after the conference has 30 days after being served or joined. The calculator below is loaded with 14 days; RuleX keeps the date in the case.
Deadline calculator: Fed. R. Civ. P. 26(a)(1)(C)
Loaded with the 14-day period from Fed. R. Civ. P. 26(a)(1)(C). Enter the date of the rule 26(f) conference; the period stays editable for an order or stipulation that sets a different one. Intermediate weekends count; the final day moves when required.
The statutory federal holidays are included. Standard observed closures apply when selected above. Confirm the district’s holiday and closure calendar and add relevant local dates. Review the triggering rule and any scheduling order alongside the result.
Read Rule 26 — Cornell LII01 / PRACTICE NOTES
The trigger is the conference, and the date is at or within 14 days after it.
Rule 26(a)(1)(C) requires initial disclosures at or within 14 days after the parties' Rule 26(f) conference, unless a different time is set by stipulation or court order, or unless a party objects during the conference that initial disclosures are not appropriate in the action and states the objection in the proposed discovery plan. In ruling on the objection, the court determines what disclosures, if any, are to be made and sets the time for disclosure.
The trigger is the conference itself, not service of anything, so the Rule 6(d) extension for service is unavailable and the calculator hides it. Rule 6(a)(1) still counts the days: exclude the day of the conference, count every following calendar day and include the last day. A conference held Monday, February 1, 2027 reaches day 14 on Monday, February 15, 2027, Washington's Birthday. The deadline moves to the end of Tuesday, February 16, 2027.
The conference date itself deserves a line in the case notes, recorded from the joint report or the minute entry. The parties must confer as soon as practicable and in any event at least 21 days before a scheduling conference is to be held or a scheduling order is due under Rule 16(b), except in proceedings exempt from initial disclosure or when the court orders otherwise (Rule 26(f)(1)).
02 / PRACTICE NOTES
What the disclosure contains.
Unless an exemption applies or the court or the parties agree otherwise, a party gives the other parties, without waiting for a request, the name and, if known, the address and telephone number of each individual likely to have discoverable information that the disclosing party may use to support its claims or defenses, with the subjects of that information, excluding material used solely for impeachment. It also provides a copy or a description by category and location of the documents, electronically stored information and tangible things it may use, a computation of each category of damages with the supporting materials, and any insurance agreement under which an insurer may be liable to satisfy part or all of a judgment (Rule 26(a)(1)(A)).
A party that is first served or otherwise joined after the Rule 26(f) conference makes its initial disclosures within 30 days after being served or joined, unless a stipulation or court order sets a different time (Rule 26(a)(1)(D)). For a defendant served on Tuesday, December 1, 2026, enter December 1, 2026 and 30 days, which gives Thursday, December 31, 2026.
Rule 26(a)(1)(B) lists the proceedings exempt from initial disclosure. Confirm whether the case falls in one of the listed categories before calendaring a date.
03 / PRACTICE NOTES
Disclosures carry consequences and a continuing duty.
A party that fails to provide information or identify a witness as required by Rule 26(a) or (e) is not allowed to use that information or witness to supply evidence on a motion, at a hearing or at a trial, unless the failure was substantially justified or is harmless (Rule 37(c)(1)). The practical effect is that the disclosure date doubles as the date by which the witnesses and documents you intend to use are on the record.
Discovery from any source opens after the Rule 26(f) conference, except where the rules, a stipulation or an order authorize earlier discovery (Rule 26(d)(1)). Disclosures, the discovery plan and the first discovery requests therefore cluster in the weeks after the conference, and one task list covers all three.
Rule 26(e) imposes a duty to supplement or correct a disclosure in a timely manner when the party learns that in some material respect it is incomplete or incorrect. Calendar a recurring review date after the first disclosure so supplements follow case developments.
04 / PRACTICE NOTES
Stipulations and orders replace the default 14 days.
The parties' proposed discovery plan is where the date is often reset. A stipulation, the Rule 16(b) scheduling order or an order ruling on an objection can set a different disclosure date, and that date controls. Read the scheduling order the day it issues and replace the calculator date with the order's date when they differ.
Add the state holidays of the district and any closure of the clerk's office to the calculator. Rule 6(a)(6)(C) counts days declared holidays by the state where the district court is located for periods measured after an event.
05 / PRACTICE NOTES
RuleX keeps the initial disclosures date in the case, next to its source.
Create the case in RuleX, add a task for the initial disclosures with the calculated due date, and attach the discovery plan, the scheduling order and the client documents. The case log records the rule, the trigger date and the holidays you applied, so every lawyer on the matter reads the same calculation and can reopen the source behind it.
Ask RuleX to organize the case documents by witness and subject, and to draft the witness list, the document description and the damages computation in Word. Research, drafting and the calendar date live in one case file with the documents, and the 7-day free trial lets you set up your first matter today.
